Terms of Service

1. Agreement and scope

These Terms of Service govern how you use cloudshifthq.com (“the Site”) and how you request advanced driver coaching (“Training”) offered through the Site. By accessing the Site or requesting Training, you agree to these Terms.

If you do not agree, do not use the Site or request Training.

2. Provider identity and essential service details (distance arrangements)

For distance contracts (including online arrangements), before the contract is concluded we provide clear, accessible, and reliable information to identify the business and the essential service details. This requirement is based on Закон України "Про захист прав споживачів" (від 10.06.2023 № 3153-IX) Стаття 13 and Закон України "Про захист прав споживачів" (від 10.06.2023 № 3153-IX) Стаття 17.

We also provide service information in the state language requirements (see Закон України "Про забезпечення функціонування української мови як державної" Стаття 30).

3. Training outcomes are not guaranteed

You acknowledge that Training results depend on many factors, including your practice outside sessions, personal skills and learning pace, weather and traffic conditions, and the specific needs of your situation. Therefore, we do not guarantee any specific outcome (including passing an exam, achieving a particular score, or any legal or administrative result).

4. Scheduling, sessions, and conduct

Training sessions are scheduled based on availability. Unless otherwise agreed, the exact time and format are confirmed before the session.

You must arrive on time and follow instructor instructions for safety. Any behavior that creates risk or disrupts the session may result in termination of the session.

If you need to reschedule, you must do so promptly using the contact details provided on the Site.

5. Assessments and feedback

If the Site or instructors provide assessments, they are informational and based on observed performance during the relevant session(s). Assessments do not guarantee future performance under other conditions.

You may receive recommendations and materials. You are responsible for implementing them and for the safety of your actions.

6. Communications and acceptable use

You agree to use the Site and request Training only for lawful purposes. You must not submit false information, interfere with the Site, or attempt unauthorized access.

We may contact you about scheduling, session logistics, and updates related to your request.

7. Personal data and lead/contact forms

If the Site collects personal data (for example, via forms), we process it in accordance with Закон України "Про захист персональних даних" від 01.06.2010 № 2297-VI. Where applicable, we provide required information to data subjects (including purposes of processing and other information required by law).

8. E-commerce information (if applicable)

If you place orders or otherwise accept an arrangement online as an e-commerce provider, the Site provides direct, simple, and stable access to identifying information required by law. This is based on Закон України № 675-VIII від 03.09.2015 "Про електронну комерцію" Стаття 7.

9. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be excluded under applicable Ukrainian law.

You are responsible for your vehicle and compliance with traffic rules during any practice.

10. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site. Your continued use of the Site after changes means you accept the updated Terms.
